Serve Borang 1 dan 2 & Afidavit Penyampaian

Hai.. Bertemu lagi kita.. Lepas buat entry n tutup laptop semalam baru teringat. Proses berkenaan borang 1 dan 2 ni sebenarnya belum selesai. Korang kena serve pulak borang ni. So, entry kali ni adalah untuk ajar korang macam mana nak serve & selepas serve kat semua tempat, prepare Afidavit Penyampaian.

Mula-mula, pastikan korang dah photostat 4 copy of the whole set. Korang pegang yang original. Pastikan yang original tu tak hilang dan sentiasa dalam simpanan korang sehinggalah tamat chambering nanti. 

Korang hendaklah serve kat tempat-tempat yang disenaraikan dibawah, tak kisah turutan mana dulu. Tapi masa serve tu, pastikan korang suruh orang yang menerima tu cop penerimaan di belakang copy original korang. Maksudnya, bagi orang kaunter tu satu original dengan satu photostat copy. Yang photostat dia akan ambil dan original tu dia akan cop di bahagian belakang dan pulangkan kat korang. Simpan~! Itu bukti yang korang dah serve borang tersebut. So tempat-tempatnya adalah seperti berikut:

• Bar Council Malaysia (Tingkat Bawah)
  No. 13,15 & 17, Leboh Pasar Besar
  50050 Kuala Lumpur.
• Jawatankuasa Peguam Kuala Lumpur (Ikut negeri masing-masing laa)
  Tingkat 8, Wisma Kraftangan,
  Jalan Tun Perak
  50050 Kuala Lumpur.
• Jabatan Peguam Negara (ada 2 AGC kat Putrajaya, make sure yang Parcel C, bukan yang lagi satu)
  Blok C3, Parcel C, 
  Kompleks Jabatan Kerajaan, 
  62510 Putrajaya.

So, lepas anda serve semua borang-borang tersebut di tempat yang telah disenaraikan di atas, prepare sebiji Afidavit Penyampaian seperti yang berikut:-

Selepas korang dah prepare Afidavit Penyampaian seperti di atas. Korang boleh proceed untuk filekan di Mahkamah melalui E-Filing seperti dalam post sebelum ni. Lagi senang kalau firm korang ada application untuk e-filing. 

Lepas ni.. Kita teruskan untuk process Borang 3, 4 dan 5 k.. Yang penting BELAJAR during your chambering period~!!

Filling in Borang 1 dan 2

Salam and Hye.. We meet again.. So, sekarang I will teach you on how to fill in your Borang 1 and 2. It is a bit tricky as the Mahkamah Tinggi (Rayuan & Kuasa-Kuasa Khas) are very particular on how you fill in this forms. Kita isi borang 1 dulu.. 

This is BORANG 1. You can save and print it.

1. You won't have the Petisyen Number sehinggalah you file in the Borang 1 dan 2. So, for now, just leave it blank.
2. Write your name in full right after the word 'Dalam Perkara'.
3. Write your home address in below your name.
4. Write your name again in full, with your NRIC no at the bottom of your name.
5. For Clause 4, Fill in with your qualifications complete with your university. E.g: IJAZAH SARJANA MUDA UNDANG-UNDANG, UNIVERSITI MALAYA.
6. For Clause 5, Fill in your Master's Full Name and your firm's address.
7. Fill in the date of filing the Petition (Borang 1).  
8. Write your name on below the AFIDAVIT on page 2 of Borang 1.
9. Fill in your firm's name at the bottom of page 2. E.g: alamat penyampaian Pempetisyen adalah di Tetuan Lee Ong & Kandiah, D2-3-1, Block D, Solaris Dutamas, No.1, Jalan Dutamas 1 50480 Kuala Lumpur.
10. Get your Borang 1 affirmed by the Commissioner of Oaths. (you will have to pay RM 4.00 for each affirmation by the Commissioner. 

Now we move on to Borang 2. Borang 2 looks like this. You may print this copy.

Isi Borang 2 pulak. Macam ni...

1. Macam borang 1 jugak, you won't be knowing your petition number until you file in the borang.
2. Likewise borang 1, isi your name and home address on top right of the Notis (Borang 2).
3. Then fill in your full name and address. 
4. Fill in the date of filing and sign the notis.
5. Alamat at the bottom will be the firm's address.
6. Get a photostat copy of the below documents and make sure it is certified true copy (can be done by any lawyer in your firm)
• Birth Certificate
• Identity Card
• Bachelor Degree Certificate (preferably in BM) 
• Master's Profile (http://www.malaysianbar.org.my/find_a_lawyer.html)

After you have filled up both borang 1 and 2. Now you can proceed with filing. Check out whether your firm have e-filing application. If not, you will have to go to court to file the documents. 

E-Filing at Your Respective Firm Procedure

1. Scan all the documents in order.
2. Submit all the documents at the E-Filing Portal under New Case.
3. Type your name as the first party and leave the other party BLANK.
4. Submit the 3 documents. (Borang 1 (Petisyen), Afidavit, Borang 2 (Notis))
5. After 1 day, check the status of the documents. If they have been successfully processed and filed, you will get your petition number. write your petition number on Borang 1 and 2 at top left corner.
6. Photostat 32 copies of borang 2 and 4 copies of borang 1 and sent the 32 copies at the RKK counter.  

E-Filing at the Court Procedure

1. Proceed to the E-Filing Counter (Right after you enter the court, the E-Filing counter will be on the right of the staircase). 
2. Get a filing form from the number counter. (you don't have to queue to get the form)
3. Fill in the form as per below
• Petisyen Penerimaan Masuk Sebagai Peguambela dan Peguamcara
• Afidavit
• Notis
4. Queue at the same counter. You will get the number and you have to pay the scanning fees at the Kaunter Bayaran. (Scanning fees is RM 50.00)
5. After you pay, go back to the E-Filing Department and wait for your number to be call. 
6. When your number is called, present the RM 50.00 receipt and all the documents (Borang 1, Afidavit and Borang 2).
7. While they are scanning, you will have to pay the filing fees at the Kaunter Bayaran (this time RM 98.00). 
8. After they have completed scanning, they will call your number again and now your documents are filed in the court.
9. Proceed to the photostat shop at B1 and tell them you need to photostat for chambering purposes.
10. they will photostat borang 1 (4 copies) and borang 2 (32 copies).
11. Proceed to RKK Counter (Level 2), and submit all 32 copies to the counter. 
12. Boleh balik makan ikan bakar daaa~!!

That is how you do your filing. It is much much easier if your firm have the e-filing application.  Should you have any difficulties in filing or did not understand any steps, please do not hesitate to leave a comment. i will try to help you.

What to do on your first day??

Assalamualaikum and Hye to everyone..

I created this blog dengan niat yang tulus dan ikhlas ingin membantu rakan-rakan diluar sana yang bakal masuk ke dunia kepeguaman dan dalam masa yang sama berkongsi pengalaman sebagai seorang Pelatih Dalam Kamar (PDK) or Pupils in Chambers. A lot of questions I heard from my colleagues, "What should I do on the first day?" "Should I sit in the library and read the books?" "Should I this, should I that?".

To answer the questions, let me tell you what I did and how it goes. First of all, make sure you and punctual; which means by 8.30, you should be there at the office. Dress in full court attire (first impression is always important), and smile as you enter your new firm's door. Greet the receptionist (if they have one) nicely. Inilah orang yang akan banyak membantu sepanjang anda di firm nanti. Make sure permulaan anda betul. 

Start with "Good Morning or Assalamualaikum". Then introduce yourself as a new chambering student. Usually, the receptionist will show you your desk. Settle down with all your stuffs, and start to greet everyone. BE HUMBLE~!! That is the main point! Perkenalkan diri anda, and say dat your are a new chambering student here and sila tunjuk ajar. Try to remember all the clerks name. By day 2 or 3, you should be able to know all the staffs. 

After getting to know the staffs, do your courtesy call to all the lawyers. Start with the Senior Partners. The usual question would be: "What do you want to do here?" Be prepared with a solid answer. Bagitau what department do you want and why you want it. For me, I told them that as I wouldn't have any locus until my short call, I would like to give a try on Conveyancing. As time goes by, maybe a lil bit of banking, general lit and corporate. Make sure what you are interested in are available in the firm. JANGAN cakap anda nak buat criminal law sedangkan kat firm tu takde buat criminal. You are killing yourself right there and then. 

After getting to know all the firm's personnel. Prepare your Petition for Admission (Borang 1,2 and 3). Where you can get it? You can print it here (in the next post). It might looked a little bit blur. Otherwise, you can purchase it for RM 5 at the Bar Council (bukan KL Bar ye...) It's your choice.

Masa I dulu, I prepare all the necessary documents on the 2nd day as on the 1st day sibuk sangat dok jumpa semua lawyer. Try the best untuk jumpa semua lawyer so that they feel that you are humble and willing to learn. So, in the next post, I will teach you how to isi the borang and how to file it. Till then.
